Acceptance of Terms

By downloading, installing, or using DeskFit AI ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

These Terms apply to all users of DeskFit AI, including free and Pro subscribers.

Description of Service

DeskFit AI is a fitness application that uses artificial intelligence to generate personalized workout plans for desk workers. The App provides:

• AI-generated workout plans tailored to your location, duration, and fitness goals
• Guided workout sessions with timers and exercise instructions
• Progress tracking and workout history
• Optional Pro subscription for unlimited access

Free Tier & Pro Subscription

DeskFit AI offers a 7-day free trial with full access to all Pro features. After the trial period, a Pro subscription is required to continue using premium features.

Subscriptions are managed through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

You can manage or cancel your subscription at any time through your Apple ID account settings.

Health & Fitness Disclaimer

Before starting any new exercise program, consult your physician or a qualified health professional, especially if you have any pre-existing medical conditions, injuries, or health concerns.

By using the App, you acknowledge that:

• Exercise involves inherent risk of injury
• You are solely responsible for how you perform exercises
• Calorie estimates are approximations only and not medically accurate
• AI-generated workout plans are general suggestions, not personalized medical advice

AI-Generated Content

Workout plans in DeskFit AI are generated using artificial intelligence. While we strive for quality and safety, AI-generated content may occasionally contain errors, inappropriate suggestions, or plans that are not suitable for your specific condition.

tessbuild makes no warranty that AI-generated workout plans will be accurate, complete, or appropriate for your individual needs.

User Conduct

You agree to use DeskFit AI only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to reverse engineer, decompile, or tamper with the App
• Use the App in any way that could damage or impair its functionality
• Circumvent any access controls, paywalls, or usage limits
• Use the App for any commercial purpose without written permission

Intellectual Property

DeskFit AI and all its content, features, and functionality — including but not limited to the design, code, graphics, and AI-generated plans — are owned by tessbuild and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

Privacy

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your information when you use DeskFit AI.

By using the App, you agree to the collection and use of information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by applicable law, tessbuild shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to personal injury, property damage, loss of data, or loss of profits — arising out of or related to your use of DeskFit AI.

tessbuild's total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

Disclaimer of Warranties

DeskFit AI is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

tessbuild does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Changes to Terms

tessbuild reserves the right to modify these Terms at any time. When we make changes, we will update the effective date at the top of this page. Continued use of the App after changes constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Termination

tessbuild reserves the right to suspend or terminate your access to DeskFit AI at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, tessbuild, or third parties.
